RECOMMENDATION:                                                                                                                       

Approve UTA.01.15 Federal Railroad Administration Drug and Alcohol Plan which updates UTA policy to reflect current requirements as set by the Federal Railroad Administration (FRA).                     

BACKGROUND:                                                                                                                                 

FRA requires UTA to adopt a drug and alcohol policy. FRA requires that we utilize their template as our policy. In the most recent FRA/UTA audit, FRA required that we update the policy. This Policy meets FRA requirements and has been approved by FRA.

DISCUSSION:                                                                                                                                      

This policy focuses solely on FRA required drug and alcohol policy and is required to be distinct from UTA’s Federal Transit Administration (FTA) and UTA’s Supplemental Policies. Together, the three policies constitute UTA’s Drug & Alcohol Policy.

For a summary of changes, please see the executive summary document included with UTA.01.05 Supplemental Drug and Alcohol policy included on this same board meeting agenda.

ALTERNATIVES:                                                                                                                                    

If this policy is not adopted, the previously adopted version will remain active and out of compliance with FRA regulations. This updated FRA Plan is required by the Federal Railroad Administration.

FISCAL IMPACT:                                                                                                                                

The modification to this policy is not anticipated to increase UTA’s drug and alcohol program costs. In addition, the updates will avoid fines in the future as the proposed policy is complaint with federal regulations.
