RECOMMENDATION:                                                                                                                       

Approve and authorize Executive Director to execute the pass-through funds agreement with the Utah Department of Transportation (UDOT) for the FrontRunner extension to Payson .                         

BACKGROUND:                                                                                                                                 

Under 2022 HB3 the Utah State Legislature allocated (for UDOT’s administration) a one-time total of five million dollars ($5,000,000) from the General Fund, one-time schedule of programs to the Transportation Investment Fund for fiscal year 2022-2023, intending that the funds be used for the Front Runner commuter rail system for a use up to $5,000,000 for planning and environmental analysis to extend Front Runner to Payson, including station area planning as appropriate.

 

UDOT now has oversight and supervisory responsibility for fixed guideway capital development projects when state funding is included.  UTA plans to perform work on the extension of FrontRunner to Payson and UDOT has designated UTA as the agency that will perform the work for the extension.

 

The passthrough funds from UDOT to UTA cannot be provided without an agreement.

 

 

DISCUSSION:                                                                                                                                      

The purpose of this Agreement is to establish pass-through funds from UDOT to UTA.  These funds facilitate UTA’s extension of FrontRunner to Payson. 

 

                     Funds paid in four quarterly installments beginning June 1, 2024, $1.25M paid in each installment.

                     UTA to spend 100% of funds by December 31, 2028.

                     The funds will be used to complete alternatives analysis, scoping, National Environmental Policy Act (NEPA) documentation in coordination with Federal Transit Administration (FTA), 30% design, 25% Union Pacific design, advanced right of way acquisitions, evaluation of funding options.

                     The Payson project objective is to extend the existing FrontRunner system to Payson City in approximately the rail corridor that UTA currently owns.  There are 3 stations identified in Springville, Spanish Fork and Payson Cities.  There would also be a light maintenance facility location identified.

                     UTA is subject to UDOT oversight and supervisory responsibility.  UTA will provide a written report of the project status by the completion of the project.  UTA will also provide UDOT with a final itemized written report detailing expenditures of the funds.

                     UTA may be responsible to submit reports or respond to inquiries from the Utah Legislature and Governor’s office and respond to request for information about the project funds.

 

ALTERNATIVES:                                                                                                                                    

UTA could refuse state funds for the project. No other local funding sources have been identified. The project would likely not be implemented. 

FISCAL IMPACT:                                                                                                                                

Signing the agreement is financially beneficial to UTA granting the Authority $5M for work on the Payson extension.
