RECOMMENDATION:                                                                                                                       

Approve the Utah Department of Transportation (UDOT) Double Tracking Construction Betterment Agreement as part of UDOT’s new Shepard Lane Interchange project and authorize the Executive Director to execute the agreement and associated disbursements in the amount of $3,576,341.42 .                                           

BACKGROUND:                                                                                                                                 

In 2019, UDOT requested that UTA review and comment on the Environmental Assessment (EA) document which was being prepared for a new I-15 Interchange located in Davis County at Shepard Lane.  Shortly after UTA provided comments on the EA, UTA was invited to participate in design coordination meetings.  Several of the comments provided to UDOT dealt with the need to accommodate a future FrontRunner double-track in this location.  Over the past two years, UTA has worked closely with UDOT in identifying what would be needed to accommodate this future-double track and how it would fit with the new interchange design.  In 2022, UTA determined it would be significantly cheaper and more efficient if UDOT’s contractor were to build the double-track section (embankment and sub-ballast) as part of the interchange project.

A previous agreement was brought to the UTA Board on January 26, 2022 to proceed with the design of the double-track section and related infrastructure items.  The design is now complete and UDOT is in the process of advertising for a contractor to build the project.  This new agreement is a Betterment Agreement with UDOT stating that UTA will be responsible to pay for the double-track amenities in the project.

 

DISCUSSION:                                                                                                                                      

Signing the Betterment Agreement with UDOT will authorize UDOT’s selected contractor to build UTA’s future FrontRunner double-track section (embankment and sub-ballast) in the area of the new Shepard Lane Interchange.  These funds are programmed in the 2023-2027 Five-year Capital Plan. A request for these funds ($3,576,341.42) will be made in the UTA 2024 Capital Budget.  This will correspond to when the work will be performed and billed by UDOT.

ALTERNATIVES:                                                                                                                                    

The selected UDOT contractor could build the Shepard Lane Interchange and not do any construction of the FrontRunner double-track section.  Later, when needed for FrontRunner, UTA could procure their own contractor to build the double-track section and a higher cost and a significantly more complicated construction project having to build around the new interchange.

 

FISCAL IMPACT:                                                                                                                                

The Betterment Agreement amount requested ($3,576,341.42) is included in the 5-year capital plan, and programmed for the 2024 UTA Capital Budget.
