RECOMMENDATION:                                                                                                                       

Approve and authorize Executive Director to execute Reimbursement Agreement with Union Pacific for Preliminary Engineering and Legal Expenses in the amount of $1,678,000                     

BACKGROUND:                                                                                                                                 

UTA has identified sections of double tracking as a part of the Initial Investment Plan to improve FrontRunner speed and frequency. Each of the projects requires coordination with the Union Pacific Railroad Company (UP).  Several of the projects require modifications to the UP Railroad to accommodate a second UTA FrontRunner track.  UP requires the execution of a Preliminary Engineering (PE) Reimbursement Agreement to enable design coordination and review during the environmental study and final design process. The PE agreement commits UTA to compensate UP for the engineering review fees that they will incur as a result of the project.  The agreement commits UP to coordinate with UTA and review design submittals in a timely manner.

 

DISCUSSION:                                                                                                                                      

UTA is initiating environmental studies and design of several FrontRunner improvement projects that will require UP review of proposed modifications to UP track, signal systems, operations, and areas for which UTA proposes to purchase UP right-of-way. UP uses consultants to coordinate, perform engineering reviews, and make recommendations to UP management for official approval. UTA and UP will also amend the original Purchase and Sale Agreement (2002) to account for new right-of-way purchase, operational changes, and new construction project coordination. This PE agreement covers the cost of the consultants and UP labor to perform these activities. UP will record actual costs of this work and will submit to UTA on a monthly basis for UTA review and reimbursement.

ALTERNATIVES:                                                                                                                                    

UTA could decide to design and construct all FrontRunner system expansion project improvements on existing UTA property (where available) or purchase only private right-of-way (where UTA property is not available). This approach will be more expensive, result in significant impacts to adjacent residents and businesses, and delay the progress of these projects

FISCAL IMPACT:                                                                                                                                

$1,687,000 cost to the FrontRunner Forward Project Budget.  Significant cost saving are expected by impacting UPRR versus adjacent businesses and residents.
