RECOMMENDATION:
Approve Resolution R2024-05-04 authorizing the Executive Director to execute a Cooperative Agreement with UDOT to receive $1.5M in Surface Transportation Block Grant (STBG_COVID) funds to reimburse UTA for the purchase of future transit Right of Way (ROW) 23.66 acres of land at approximately 400 West North Street, Harrisville, Utah.

BACKGROUND:
UTA purchased the 23.66 acres of raw land located at approximately 400 West North Street, Harrisville. Its intended purpose is a park-and-ride lot to serve future transit service to Brigham City. The land was purchased in May 2023 from Tinslee Meadows, LLC for $1,656,200.
In coordination with Wasatch Front Regional Council (WFRC), UTA purchased this property with the intent of seeking reimbursement from a previously awarded STBG grant. UTA applied for $5M in STBG funds in 2021 for transit ROW preservation. Of that amount, UTA was awarded $1.5M. Because COVID funds are still available and nearing expiration, WFRC determined the STBG funds, originally selected for the project, be used elsewhere and UTA’s project would be assigned the $1.5M in STBG_COVID funds which currently is identified in the Utah Department of Transportation (UDOT) Statewide Transportation Improvement Plan (STIP) under PIN 20308.
Normally, funds UTA has been selected to receive through the Metropolitan Planning Organization are transferred from Federal Highway Administration (FHWA) to Federal Transportation Administration (FTA) and then UTA obligates the funds in the FTA’s award management system. However, given the urgency to use the COVID funding, the money remained with FHWA and is being administered through UDOT. This Cooperative Agreement is the mechanism for UTA to be reimbursed for the expenditures already incurred.

DISCUSSION:
UTA will comply with FHWA requirements for acceptance of the funds. Post award requirements follow the Uniform Guidance or 2 CFR 200. UTA is experienced with the tracking of federally funded real property assets.
This Cooperative Agreement also acts as the grant agreement for the awarded funds and will be retained in the Grant Department records.

ALTERNATIVES:
UTA can refuse the Cooperative Agreement and the awarded funds.

FISCAL IMPACT:
UTA will be reimbursed $1.5M
