RECOMMENDATION:
Approve and authorize the Executive Director to execute the contract and associated disbursements with Acme Construction, Inc. in the amount of $2,163,495.22 for the Construction of the Clearfield Rail Trail project.

BACKGROUND:
June of 2023, UTA released a request for procurement (RFP) for Qualified Construction Firms to contract with to construct the proposed tail. At the close of the RFP only one bid was received. To foster more competition and solicit more bidders, the RFP was re-advertised in February 2024. In March 2024, still only one bid was received and evaluated, and Acme Construction was selected as the winner. The Procurement Specialist surveyed non-responding firms to confirm the UTA requirements were not overly restrictive and learned that other vendors did not respond only because they were already at full capacity with all the work in the area. An Independent Cost Estimate (ICE) was also performed to ensure the price was fair and reasonable.
By constructing this trail we will be able to meet the following goals for the project:
1: Improve access to the Frontrunner station
2: Eliminate single point of entrance into the station
3: Eliminate trespassers who illegally cross the railroad tracks
4: Provide better access for Freeport Center employees and Job Corp students

DISCUSSION:
UTA Staff is requesting approval of the contract with Acme Construction, Inc. in the amount of $2,163,495.22. The scope of the project is to construct a paved multi-use trail that connects the UTA FrontRunner Clearfield Station to the Rio Grande Rail Trail and the Freeport Center. Adding a trail system connecting to the Clearfield FrontRunner Station will greatly improve access to and from the surrounding areas. Currently there is only one entrance to the station, and it is not very pedestrian or biker friendly. People coming from the west of the station have a long and circuitous route to obtain entry. . Constructing this trail can help reduce travel distance by approximately half a mile on each end.
