RECOMMENDATION:
Approve and authorize the Executive Director to execute Supplement No. 4 to the existing Salt Lake City Corporation TIGER Stakeholder Agreement which provides additional UTA funds for the 300 North Pedestrian Bridge Project.
AND
Approve 2022 technical budget adjustment moving $300,000 from UTA project NP-60 “Public Partnership Projects” to UTA project MSP-205 “TIGER Program of Projects”.

BACKGROUND:
Agreement Supplement No. 4
TIGER Stakeholder Agreement (Stakeholder Agreement 18-02298BM) was executed on February 19, 2019 for the Salt Lake City Projects: the Folsom Trail Project (SLC_MUP_1) and the 300 North Pedestrian Bridge Project (SLC_OP_1) as part of the TIGER First/Last Mile Program.
Supplement No. 1 between UTA and Salt Lake City Corporation was executed on February 19, 2019 for design and construction of the Folsom Trail Project (SLC_MUP_1).
Supplement No. 2 between UTA and Salt Lake City Corporation was executed on March 6, 2020 for design and construction of the 300 North Pedestrian Bridge Project (SLC_OP_1).
The Stakeholder Agreement, including Supplements No. 1 and No. 2, was approved by Resolution R2020-02-05 of the UTA Board of Trustees on February 26, 2020.
Supplement No. 3 between UTA and Salt Lake City Corporation, which added additional funds for the Folsom Trail project, was approved by the UTA Board of Trustees as a revenue contract on June 24, 2020.
This Supplement No. 4 proposes to increase the agreement project budget for the 300 North Pedestrian Bridge Project (SLC_OP_1) by $2,425,845, to be funded by State of Utah American Rescue Plan Act funds (ARPA), WFRC STP Funds, UTA partner funds, and Salt Lake City Corporation.
Technical Budget Adjustment
The 2022-26 Adopted 5-Year Capital Plan included $10 million in 2022 for Public Partnership Projects intended to support transit investments by UTA’s local partners. This funding was programmed in project NP-60 with the intent of using the funds to support these local transit related projects.
This Technical Budget Adjustment would move $300,000 from the Public Partnership Project (NP-60) to the TIGER Program of Projects project (MSP-205). There would be no impact to the total 2022 budget amount and this action would not affect fund balances.

DISCUSSION:
Additional funding for the 300 North Pedestrian Bridge Project was received following execution of the Stakeholder Agreement and Supplement No. 2. This additional funding needs to be added to the existing agreement project budget.
This technical budget adjustment request moves $300,000 from project NP-60 to project MSP-205 as part of UTA’s contribution to the project.

ALTERNATIVES:
Without the additional funding the 300 North Pedestrian Bridge Project could not be completed.

FISCAL IMPACT:
The additional funding will increase the overall agreement amount for this project by $2,425,845. This amount was anticipated and accounted for in the approved 2022 Capital Budget. No additional UTA budget authority is required.
