RECOMMENDATION:
Approve and authorize the Executive Director to execute Change Order No. 1 - Authority to Proceed No. 2 (ATP2) and associated disbursements with Stacy & Witbeck Inc (SWI) in the amount of $13,978,978 with $3,400,000 to be allocated in 2024.
BACKGROUND:
On January 24, 2024, UTA Board of Trustees approved a Contract with Stacy and Witbeck, Inc (SWI) to construct the MidValley BRT (MVX) project and issued an Approval to Proceed No. 1 (ATP1) for Phase I work on the project. In order to keep the project on schedule, in March 2024 UTA requested FTA to issue a Letter of No Prejudice (LONP) for the project to continue work prior to receiving final grant approval. The LONP was approved by FTA on May 15, 2024.
DISCUSSION:
UTA staff is requesting approval to execute Change Order No. 1 and issue ATP2 on the Stacy and Witbeck, Inc contract for the MVX project. FTA has issued a LONP to allow work that is time critical to keep the project on schedule and allow for construction during the 2024 summer construction season. There is funding in 2024, 2025, and 2026 to cover these costs.
UTA staff will come to the Board for final approval of the contract once the full funding grant is received from the FTA. That is expected to take place in the fall of 2024.

ALTERNATIVES:
If this change order is not approved UTA will lose almost an entire construction season and negate the need for the LONP
FISCAL IMPACT:
Funds are available in the 2024 and 2025 years of the capital plan to cover these costs.
All funds will come from the MSP253-Mid-Valley Connector capital project in the 2024-2028 Five Year Capital Plan.
2024 Capital Budget: $10,000,000
2025 Capital Plan: $45,700,000
2026 Capital Plan: $44,987,000Total Change Order #1 $13,978,978 ($3,400,000 for 2024 and $10,578,978 for 2025)
Staff will return to the Board for final approval of the contract once the full funding grant is executed with the FTA. That is expected to take place in the fall of 2024.
