RECOMMENDATION:
Approve and authorize the Executive Director to execute the deductive change order #43 with Big D construction in the amount of -$257,183.85.
BACKGROUND:
The phase 1 contract with Big D Construction to build the Depot District Clean Fuels Technology Center was executed in August of 2018, and a change order for phase 2 was approved by the Board of Trustees on June 19, 2019.
Provisional sums were included in the change order for the underground power service from 600 West along 200 South to the UTA property for contaminated soils, railroad insurance and permits, dewatering, utility test holes, utility adjustments due to underground conflicts, inclement weather, and Union Pacific railroad monitoring and construction observation. Use of these provisional sums for items with a difficult to determine cost or quantity reduces risk to both UTA and the contractor. The contract amount for these items was $465,000. The contractor was reimbursed for actual costs of $207,816.85.
DISCUSSION:
This deductive change order is to reduce the contract amount of the provisional sums to match the actual costs incurred by the contractor and paid by UTA.
