RECOMMENDATION:
Approve Resolution R2025-11-03 to authorize the Interlocal Agreement with Willard City Cooperation and Box Elder County for the development and operation of a trail on the Historic Orchard Pathway Corridor.

BACKGROUND:
UTA purchased a portion of the abandoned Utah Idaho Central (UIC) Railroad as part of corridor preservation efforts in Box Elder County. This is a 66-foot-wide alignment which extends from 8700 South to approximately 6800 South in Box Elder County. The Regional Transportation Plan identifies the need for a trail within this corridor. The Bear River Association of Governments has applied for and obtained an Active Transportation Project Grant from the Utah Department of Transportation to fund the design and construction of the Trail on the UTA Property and the Willard Property.

DISCUSSION:
This resolution seeks approval of an interlocal agreement between UTA, Willard City, and Box Elder County (UTA contract #25-P00520) which details the roles and responsibilities of each party in the trail project. The ILA anticipates the execution of an agreement to license the eastern sixteen feet (16’) of the UTA Property to the City and County for use as a public trail. The value of the license will be treated as an in-kind contribution towards the matching portion of UDOT Active Transportation Project Grant funding, which will be used in the design and construction of the Trail. This maintains a 50-foot corridor for future transit service.
The trail will be a paved, non-motorized corridor located on the UTA Licensed Area and the City property, between 8700 South Box Elder County, north to approximately 6800 South, at which point the Trail will diverge and run along 200 West in Willard City north to 800 North in Willard City. The City and County agree to maintain all trail improvements within each of their respective jurisdictions. The term of the agreement extends 25 years from the date of execution and renews automatically for an additional 25 years. Provisions for UTA to terminate the agreement as needed for other transit use of the property are included in the agreement.

ALTERNATIVES:
If UTA chooses not to enter into this interlocal agreement, the City and County would have to look for an alternative alignment for the Historic Orchard Pathway.

FISCAL IMPACT:
Licensing of the land, which UTA purchased previously, will be provided as an in-kind contribution towards the matching portion of UDOT Active Transportation Project Grant funding. The appraised value of the UTA property license to be contributed is $381,700. UTA is not providing any additional funding for this project.
