RECOMMENDATION:                                                                                                                       

Approve the revised UTA policy UTA.01.05 Supplemental Drug and Alcohol policy to update UTA policy with recently executed State and Federal laws, and to supersede the prior UTA.01.05 policy adopted on October 22, 2021.                                           

BACKGROUND:                                                                                                                                 

UTA desires to provide a safe work environment for our employees and safe transit experience for our customers. To do so, UTA adopts a robust drug and alcohol policy. Federal requirements provide specific policy that UTA must follow and is reflected in the UTA, Federal Transit Administration (FTA), and Federal Railroad administration (FRA) policies. However, federal policy allows UTA latitude to exceed minimum drug and alcohol requirements. This supplemental policy focuses on elements of UTA’s Drug and Alcohol Policy that exceed minimum requirements of the FTA or FRA.

In the most recent FTA/UTA audit, the FTA required that UTA update the policy to more accurately reflect FTA requirements and to provide additional distinction between FTA and UTA policy. The proposed language and separation from FTA and FRA policy meets FTA requirements and has been reviewed and approved by FTA.

DISCUSSION:                                                                                                                                      

This policy focuses primarily on UTA drug and alcohol policy that is in addition to federal minimum requirements and is required to be distinct from UTA’s FTA and UTA’s FRA Policy. Together, the three policies (FTA, FRA, and UTA supplemental) constitute UTA’s Drug & Alcohol Policy.

ALTERNATIVES:                                                                                                                                    

If this policy is not adopted, the previously adopted version will remain active and non-compliant with federal requirements.

FISCAL IMPACT:                                                                                                                                

The modification to this policy is not anticipated to increase UTA’s drug and alcohol program costs. In addition, the updates will avoid fines in the future as the proposed policy is complaint with federal regulations.
