RECOMMENDATION:
Approve and authorize the Executive Director to execute Task Order 25-046 and associated disbursements on the on-call infrastructure maintenance task ordering contract with Stacy and Witbeck, Inc. in the amount of $655,493 to obtain ADA-compliance on 29 bus stops as part of the Federal Transit Administration (FTA) 5339 Federal Program funds received by UTA.

BACKGROUND:
In December 2023, UTA released a Request for Procurement for an on-call maintenance contractor focused specifically on infrastructure assets and other on-call services. Bids were received and evaluated, and Stacy and Witbeck, Inc. was selected as the winner based on overall scoring using the best value format.
On April 18, 2024, The UTA Board of Trustees approved the contract and authorized the Executive Director to execute the Master Task Ordering Agreement (MTOA) with Stacy and Witbeck Inc. on April 18, 2024. The MTOA is for three (3) years, plus two (2) one-year options, with a total 5-year not-to-exceed value of $45,000,000. This work has been verified to be within the scope of the Stacy and Witbeck on-call contract.
These projects typically address:
- Passenger ride quality
- Access to Americans with Disabilities Act (ADA)-compliant bus stops
- Safety issues

DISCUSSION:
UTA staff is requesting approval of Task Order 25-046 with Stacy and Witbeck, Inc. to complete the construction of 29 bus stops in Utah and Salt Lake Counties. The scope of this request includes time, labor, materials, and other items needed to complete these stops.
By improving and constructing these stops, we are providing ADA-compliant stops for our passengers, improving rider amenities, and adding additional safety factors. This task order is within the scope of the MTOA.
The task order pricing has been determined to be fair and reasonable based on both a UTA-independent cost estimate and the performance of a price analysis.

ALTERNATIVES:
Disapprove Task Order 25-046. UTA will be at risk of not meeting the funding and grant requirements for improving 150 bus stops. Jeopardizing the funding already received and any potential future funding opportunities.

FISCAL IMPACT:
The 2025-2029 Five Year Capital Plan includes $655,493 for ADA-compliance improvements and construction of 29 bus stops to fulfill the requirements listed in FTA grant #UT-2023-038-00. This work is anticipated to occur in 2025 under the Federal Bus Stop project (MSP301) and the costs will be offset by using FTA 5339 funds.
