Approve and authorize the Executive Director to execute the Authority Request and associated disbursements for Denner vs UTA in the amount of $250,000
BACKGROUND:
Denner vs UTA
Plaintiff was rearended by a UTA bus resulting in spinal surgery to the neck. This case was assigned claim number GL-46642-11549.
DISCUSSION:
Denner vs UTA
On December 16, 2019 the plaintiff was turning left on a green arrow when he was forced to stop for a pedestrian. He was subsequently rear-ended by a UTA bus resulting in significant damage. The plaintiff’s injury resulted in surgery to repair damage to the cervical spine. Experts for UTA reviewing this case found that the forces involved could have resulted in the injuries alleged by the plaintiff. Authorized negotiations have resulted in an agreed settlement amount of $250,000. Authority is requested to settle this case at the agreed amount of $250,000.00.

FISCAL IMPACT:
This settlement is $250,000. Funding for this settlement is budgeted as part of the 2023 operating budget for Risk and Insurance Services. As a self-insured entity in Utah, UTA is required to have a designated cash account sufficient to cover all probable losses.
