RECOMMENDATION:                                                                                                                       

Approve and authorize the Executive Director to execute Change Order No. 3 and authorize issuance of an Authority to Proceed No. 3 (ATP3), and associated disbursements, with Stacy & Witbeck Inc (SWI) in the amount of $34,309,128.  Authorization to execute change order is contingent on execution of small starts grant.                       

BACKGROUND:                                                                                                                                 

On January 24, 2024, the UTA Board of Trustee approved a contract with Stacy and Witbeck, Inc (SWI) to construct the Mid-Valley BRT (MVX) project and issued an Approval to Proceed No. 1 (ATP1) for Phase I work on the project.  To keep the project on schedule, in March 2024, UTA requested the Federal Transit Administration (FTA) to issue a Letter of No Prejudice (LONP) for the project to continue work prior to receiving final grant approval.  The LONP was approved by the FTA on May 15, 2024.  UTA issued an Approval to Proceed No. 2 (ATP2) and approved the contractor to work on the LONP items.  In December 2024, FTA approves the Small Starts Grant Agreement (SSGA) for this project allowing UTA to execute Approval to Proceed no. 3 (ATP3) for the full contract amount. 

 

DISCUSSION:                                                                                                                                      

Execution of this change order will allow Stacy & Witbeck, Inc to continue working on the MVX route construction until the construction is complete.  Their current contract is for preliminary work including utilities.  This change order would be for the remainder of the known work to complete construction of the MVX route. 

This contract is a traditional Design-Bid-Build contract.  This change order does not change the current timeframe or effective dates.  It will allow for work to commence on necessary construction that is not currently authorized in the existing contract.

If this change order is not approved, construction cannot be completed on this project. 

FISCAL IMPACT:                                                                                                                                

Funds are available in 2024 and 2025  of the capital plan to cover these costs.  All funds will come from the MSP253- Mid-Valley Connector capital project in the 2024-2028 Five Year Capital Plan. 

The majority of these costs are offset by State Allocations, State Transit Transportation Investment Funds (TTIF), and a federal Small Starts Grant Agreement.  The Small Starts Grant Agreement is expected to be executed soon.  Funding agreements are in place for the outside revenue sources.
