RECOMMENDATION:                                                                                                                       

Approve and authorize the Executive Director to execute the Land Use Agreement with Eagle Mountain City.                     

BACKGROUND:                                                                                                                                 

The Utah Transit Authority (UTA) is constructing two park-and-ride facilities in Utah County—one in Eagle Mountain City and the other in Saratoga Springs City—as part of the Utah County Park and Ride Project.

  • Eagle Mountain Facility: This site will feature a 56-stall parking lot, two bus stops (one with a shelter), a signalized pedestrian crossing (HAWK signal), an access road, and a connection to the existing multi-use path.
  • Saratoga Springs Facility: This location will include two bus stops (one with a shelter), road widening and restriping, and a signalized intersection at Pony Express Parkway and Seaside Street.

This agreement deals solely with the Eagle Mountain facility. Improvements for the Saratoga Springs Facility will be covered under a separate agreement.

Property Contribution and Agreement Terms

Eagle Mountain City is donating Parcel 58:034:0424 to UTA, as shown in Exhibit A, at no cost as an in-kind contribution to the project.

The term of the agreement is 50 years from the Effective Date, with an option to renew for an additional 25 years. The agreement may be terminated if UTA permanently discontinues or abandons transit service on the property, as defined in the Term section of the agreement.

DISCUSSION:                                                                                                                                      

By executing this Land Use Agreement, UTA agrees to construct and operate a park-and-ride facility in the northeast quadrant of Pony Express Parkway and Rock Creek Road, and to provide bus service along Pony Express Parkway.

Disapprove. Cancel the Utah County Park and Ride project as currently planned.

FISCAL IMPACT:                                                                                                                                

As part of this agreement, UTA will receive a Right to Use Land Lease agreement with Eagle Mountain City.  This would be an in-kind contribution for the term of the lease valued at $500,000. 

As part of the agreement, UTA is responsible for the construction, operation, and routine and long-term (capital) maintenance for the park and ride.  A contract for construction of the park and ride facilities is forthcoming and UTA currently anticipates this park and ride coming into service around the August 2026 change day. UTA does not anticipate any significant maintenance needs during 2026. 

Any routine maintenance budget, if needed in the future, will be requested as part of the 2027 Operational Budget preparation period.  The capital maintenance needs will be addressed through UTA’s Transit Asset Management program and will be addressed through the planning and programming of those funds, likely to occur in the FMA672 - Park and Ride Rehab and Replacement project.
