RECOMMENDATION:
Approve the Construction Materials Testing Professional Services Contract with CMT Engineering Laboratories and authorize the Executive Director to execute the contract and associated disbursements in the not to exceed amount of $500,000 over 5 years.

BACKGROUND:
On December 15, 2021, UTA issued a Request for Proposal (RFP) encouraging interested parties to submit proposals to perform construction materials testing services for various UTA construction projects as described in the RFP. Upon evaluation of the proposals submitted, UTA selected CMT Engineering Laboratories as the qualified Consultant to perform the services.

DISCUSSION:
UTA Staff is requesting the approval of Contract #21-03453VW with CMT Engineering Laboratories to perform the material testing activities on a time and materials basis. . The agreement has an initial period of performance of 2 years with three additional one-year options to be exercised at UTA’s sole discretion. The fully loaded labor rates for each category of labor to be utilized under the contract have been fixed and are considered fair and reasonable based on the competitive nature of the procurement and UTA’s independent cost estimate. UTA will be invoiced on a monthly basis per project for the hours worked and tests performed. The contract contains a Not-To-Exceed cap of $100,000 annually and $500,000 for the life of the contract including all three options.
