RECOMMENDATION:                                                                                                                       

Approve and authorize Executive Director to execute the Master Task Ordering Agreement and associated disbursements with Stacy and Witbeck Inc. in the not-to-exceed amount of $45,000,000.00 for on-call transit infrastructure design, construction, maintenance and repair for a base period of three years plus two one-year options for a total of 5 years. Individual task orders will be presented for board approval according to required approval thresholds.                       

BACKGROUND:                                                                                                                                 

In October 2023, UTA released a request for proposals (RFP) for an on-call maintenance contractor focused specifically on infrastructure assets. At the close of the RFP  in November 2023, only one bid was received. To foster more competition and solicit more bidders, the RFP was re-advertised in December 2023 for six additional weeks. Notifications were also sent to potential bidders about the re-advertisement. In February 2024 bids were received and evaluated, and Stacy and Witbeck Inc. was selected as the winner based on overall scoring using the best value format. UTA is responsible for maintaining and operating a safe and efficient transit system. The on-call contract is utilized to perform State of Good Repair and other upgrades and modifications that promote continued safe operations and to maintain our assets per our Transit Asset Management plan.

DISCUSSION:                                                                                                                                      

UTA staff is requesting approval of a contract with Stacy and Witbeck Inc. to provide on-call maintenance for UTA’s infrastructure assets in the not to exceed amount of $45,000,000. This is a three-year contract with two one-year options.

Typical task orders under this contract will include:

     • Grade crossing replacement efforts on UTA’s rail system

     • Rail maintenance to include ballast, tie, and other rail replacement activities

     • Special Trackwork procurement and installation

     • General concrete/asphalt replacement

UTA anticipates spending approximately $9,000,000 per year during the contract period, bringing the total five-year Not-To-Exceed contact amount to $45,000,000.

Without the procurement of special trackwork, we risk delays in delivery which could result in derailment and possible loss of service.

FISCAL IMPACT:                                                                                                                                

This umbrella contract with an NTE of $45,000,000 will be executed through Task orders. Task orders will provide project information and corresponding budget approval within each fiscal year. The budget for this contract  is included in the 2024-2028 Capital Plan.
